Albinator / eXtreme power License Agreement

By installing and using albinator/extreme power on your server, you agree to the following terms and conditions:

• children under age 13 can not own albinator/extreme power without parental permission.
• An albinator/extreme power license grants you the right to run one instance (a single installation) of albinator/extreme power on one web server and one web site for each license purchased. Each license may power one instance of albinator/extreme power on one domain.
• Any content hosted under Albinator Group scripts will be responsiblity of the owner of the copy of the script / the site using it.
• allowing users to edit and use copyrighted file formats is your responsiblity. The developer Albinator Group/Mayank Gandhi is not liable for its copyright infringement.
• albinator/extreme power source code may be altered (at the owners risk), but the software (altered or otherwise) may not be distributed to entities beyond the license holder without the explicit written permission from the developer, Albinator Group/Mayank Gandhi
• All products displayed with BOX's are just representation only. No products are shipped out in box's. All products are delivered via electronic means.
• All albinator/extreme power copyright notices within design templates must remain unchanged (and visible). The footer size should be minimum 9 points on visiable color scheme

  Although we will still reserve the right to may/may not display your sitename as a licensed user of the product on our website(s).
  
• Registered users may modify the albinator/extreme power code for their personal use (at their own risk), but any altered code must not be redistributed or resold in any form.
• If any terms are violated, the developer, Albinator Group reserves the right to revoke the license at any time. No license refunds will be granted for revoked licenses.
• Once you obtain the copy of albinator/extreme power scripts and then deny the Terms and Conditions your money can't be returned and you are not liable to use the scripts till you agree to them.
• we give 3 months of product related only technical support (basic functionality), though the development team may help you thereafter too.
• we have right refuse technical support if the norms of the business trade are not met or non-supportable conditions arise.
• you shall not re-sell, distribute part/full albinator/extreme power scripts in any form
• The default language pack distributed is English, all except that are donated packs by Albinator License owners and have been credited to them. Use of these packs must be done at your sole responsibility as Albiantor Group can't guarantee its accuracy.
• Free copies provided in exchange of Language Packs: License owners are eligble for a permanent license but default customer facilities are as labile (technical support, member's area access). Initial one Year license is provided and which may or may not be converted into permanent one, stipulated by the submited language pack usability at that point.
• We reserve the right to publish the licensed (albinator/extreme power owners) website url's on our website(s)/emails under the subject of Client's to our products.
• Modified Versions/Paid Addons: The modifications/additions of features/deletions/etc done are copyright of Albinator Group and we reserve the right to add them in our future versions as additional or part of the stardard package.
• Refund Policy: Once the Albinator/extreme power Scripts are sent, the payments made for the license of Albinator/extreme power shall not be refundable (non-refundable).
• Special Offers: the third party script owners (the scripts sold with Albinator as a part of the offer) will be sent your information, the time limit of delivery of the scripts is normally 3-4 days but Albinator Group can't guarantee it. The Third party onwer will send you the scripts directly. All Technical support for those scripts shall be the responsiblity of the respective developers not Albinator Group. We do not have legal merger/partnership with the third party script owners, therefore we advice you to take a look at the script demo's before buying. Selling as Combo's or Special Offers do not mean Albinator Group is recommending or rating the scripts.
• Double Checks: Due to increased rate in Internet Frauds, and we being one of the victims of it; have introduced a double check system to call you personally to confirm the payment's legitimacy. Therefore please bear with us and provide us with most suiting time to call you to confirm this status. Please note the conversation may be recorded for security reasons. Failing to do so we won't be able to accept your order.
• We reserve the right to make changes to these terms & conditions.

Disclaimer of Warranty

THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED.

The developer Albinator Group/Mayank Gandhi is not liable for the content of any message or photograph/images in the albums powered by albinator/extreme power.

The user must assume the entire risk of using the program. ANY LIABILITY OF THE SELLER WILL BE LIMITED EXCLUSIVELY TO PRODUCT REPLACEMENT.

Should we discover illogical discrepancies in the software usage or re-selling, distribution part/full albinator scripts in any form, be aware that you may lose your license and may face legal actions for Software Piracy.
